Nardone Law Group, LLC is actively involved in the legal representation of closely-held businesses, including dental and other professional practices, involving employment matters.  This representation includes (i) personnel system assessment and development; (ii)assistance with the interview process, hiring and related documentation matters; (iii) advice on the discipline and discharge of employees and related documentation matters; (iv) federal and state employment regulation compliance (e.g., discrimination laws, the Fair Labor Standards Act, Workers’ Compensation, the Familiy and Medical Leave Act, Americans with Disabilities Act); (v) Equal Employment Opportunity Commission/Ohio Civil Rights Act compliance and representation; (vi) claims for unemployment compensation benefits representation; (vii) internal and background investigations; (viii) management/supervisory training on various employment topics (e.g., discipline, discharge and documentation; performance evaluations; discriminatory harassment; interview process, hiring and documentation); and (viii) contract negotiation, administration, and arbitration.

Representative engagements include:

  1. Representing the employer in developing an employment handbook, or updating the employer’s employment handbook;
  2. Conducting background investigations as part of the hiring process;
  3. Preparing employment agreements and separation agreements and releases;
  4. Providing an analysis of discipline/discharge facts and circumstances to provide guidance, advice and options and to identify potential liability concern;
  5. Conducting Fair Labor Standards Act compliance and position audits and reports;
  6. Assisting in, and or conducting sexual harassment or other internal investigations;
  7. Representing the employer in claims for unemployment compensation benefits;
  8. Conducting legal research and providing advice on various employment issues.
